S African Sunrise can challenge Avedia's LPG offloading

Cape Town, 15 May (Argus) — South African LPG distributor Sunrise Energy has been granted leave to appeal a Western Cape high court decision to dismiss its lawsuit against smaller competitor Avedia Energy. The court's ruling on 8 May paves the way for Sunrise to resume its legal challenge of Avedia's quayside offloading of LPG at Saldanha Bay. The judge remitted the entire matter to the ports regulator in March. Sunrise said at the time that the merits of the case had not been fully considered and it would appeal the decision. The firm says the temporary authorisation given by the Transnet National Ports Authority (TNPA) for Avedia's operations contravenes Sunrise's 30-year concession, also awarded by the TNPA, to build and operate a 5,500t LPG terminal at Saldanha.
