UK to maintain EU duties on US biodiesel pending review

The UK will transpose the EU countervailing duties on biodiesel originating from the US, including that consigned from Canada, once it ceases to apply the EU's Common External Tariff.

This will apply unless the notice is revoked or the EU terminates the measure before the UK begins operating an independent trade remedies system.

The transposition of the duties will be followed by a transition review carried out by the UK Trade Remedies Authority to assess whether the measure is appropriate to the UK. The result of the review will be a recommendation that the measure be varied or revoked.

The EU anti-dumping duties and anti-subsidy duties against US biodiesel are due to expire in September, but the European Commission will consider a request made by the European Biodiesel Board to review its position on the duties. Before it starts an expiry review, the commission could consult European companies on how much support the European biodiesel industry has for a continuation of the EU measures.

The UK will also transpose anti-subsidy duties on biodiesel originating from Argentina and Indonesia as well as anti-dumping duties on bioethanol originating from the US.
