Community and environmental group have sued Plains All American Pipeline and the San Joaquin Valley Air Pollution Control District over the startup of the 70,000 b/d crude-by-rail terminal in Bakersfield, California.
The move marks the latest challenge to crude infrastructure on the west coast, where efforts to build crude-by-rail terminals have been met with lawsuits and opposition from environmentalists, citizens and politicians. Kinder Morgan's crude-by-rail terminal in Richmond, California, was also sued by environmental groups, and groups have also filed challenges to permits for crude-by-rail facilities in Washington state.
The lawsuit alleges that the terminal poses health and safety risks and that the site has never gone under an environmental review. The lawsuit was filed by Earthjustice on behalf of Communities for a Better Environment, Sierra Club, ForestEthics, Association of Irritated Residents and the Center for Biological Diversity.
