Costco agrees to cut GHG emissions, pay fine

Retailer Costco Wholesale has agreed to cut emissions of ozone-depleting and greenhouse gases at more than half of its US stores and pay a penalty for violating the Clean Air Act as part of a settlement with the federal government.

Under the agreement, Costco would improve its management of refrigerants at 274 of its 466 US stores, the Environmental Protection Agency (EPA) and Department of Justice (DOJ) said yesterday. EPA estimates that the measures detailed in the settlement would avoid emissions of more than 105,000lb of ozone-depleting refrigerants, or about 30,000 metric tonnes/yr of CO2 equivalent.

The retailer will also pay a civil penalty of $335,000 for its violations of Clean Air Act, which include failure to properly monitor, repair and record leaks of the refrigerant R-22 from 2004 to 2007. Title VI of the Clean Air Act requires many commercial refrigeration equipment owners or operators to repair coolant leaks within 30 days.

Costco agreed to utilize a refrigerant management system that would avoid and repair refrigerant leaks, cutting its average leak rate to 19pc by 2017 from 24pc in 2011. The company will also install new refrigeration and leak detection systems at all of its new stores, and retrofit the commercial refrigeration equipment at 30 of its stores.

"Cutting harmful greenhouse gas emissions is a national priority for EPA, and this settlement will lead to significant reductions of an ozone-depleting gas that is 1,700 times more potent than CO2," EPA assistant administrator for enforcement Cynthia Giles said.

The company did not respond to requests for comment.

The consent decree filed yesterday in the US District Court for the Northern District of California is subject to a 30-day comment period and is contingent on final court approval.
