Poland fines Gazprom and NS2 partners

Polish competition authority UOKiK has imposed large fines on Gazprom and its financial partners in the delayed 55bn m³/yr Nord Stream 2 project.

UOKiK has imposed penalties on each of the six firms equalling 10pc of their annual turnover — the highest possible fine under Polish competition law — for breaching Polish and EU competition laws, it says.

The companies facing fines are Gazprom and its five financial backers for Nord Stream 2 — Shell, Austrian integrated oil firm OMV, German utility Uniper and oil company Wintershall, and French energy firm Engie. The fine for Gazprom is as much as 29bn zlotys ($7.6bn) and 30mn-87mn zlotys for the other five firms.

Gazprom and its partners filed an application to UOKiK in 2015 for approval to create a joint venture to build the pipeline to Germany. When UOKiK refused the request, Gazprom withdrew its application and created a wholly owned a subsidiary to develop the project with financing from its European partners — a move that attempted to bypass Polish and EU competition laws, UOKiK says.

The Russian company disagrees with the UOKiK ruling and intends to appeal against it, Gazprom said on 7 October. The fines on all six firms will not be formally imposed until the appeals process is completed. The unprecedented scale of the fines "indicates a desire to oppose the implementation of the Nord Stream 2 project by any means", Gazprom said.

Poland strongly opposes the project, which threatens the competitiveness of gas supplies and the country's role in Russian gas transit to Europe, it says.

UOKiK fined Engie 172mn zlotys in November for refusing to co-operate with the investigation. A fine of €50mn was imposed on Gazprom in August for the same reason. In each case, the companies have lodged appeals.

Nord Stream 2 construction halted late last year because of US sanctions targeting pipelaying firms — only around 160km of the offshore route remains to be laid. Gazprom had planned to commission the pipeline by the start of this year.
