Brazil asks for new deadline on Ceara gas rules

Brazilian natural gas industry associations want to postpone a deadline to propose changes to Ceara state's piped gas distribution regulation.

In Brazil, each state and the country's federal government define their own laws and regulations on natural gas distribution. Possible amendments to Ceara's law, which was approved in January, are being discussed by state officials, but the northeastern state wants to publish the sector's regulations before finalizing those amendments. The regulations are aimed at spelling out the details for the law, but the gas sector associations say that releasing the regulations while the base law is still being discussed is hasty.

Ceara proposed a public consultation from 24 October-8 November to discuss its gas distribution regulation. But associations are having trouble presenting their suggestions to the state regulatory agency Arce and are considering the entire process too hasty, as the law underlying the regulation is still under discussion, they told Argus.

On 28 October, the associations formally requested a deadline extension for the consultation, but Arce has yet to respond. According to the Brazilian association of independent oil and gas producers (ABPIP), they have not even received confirmation that their request was received by the regulator.

Both consumers and producers complain that Ceara's gas regulation creates trading fees and imposes bureaucratic hurdles for consumers seeking to migrate from gas supply agreements signed with the state gas distribution company to a bilateral contract.

Ceara state's regulation scored 37 out of 100 on a ranking by large energy consumers' association Abrace that considers how each state addressed regulation on gas distribution on topics such as trading, the transition from the regulated to the bilateral market, penalties and distribution tariffs. That is the tenth lowest score out of 19 states.

ABPIP and other associations also requested that Ceara hold an in-person public hearing to receive proposals, but the state did not respond.

While Arce fails to respond to requests to extend the consultation deadline or hold a public hearing, associations are filing individual suggestions. ABPIP has proposed more than 20 changes, including the exclusion of a chapter that ruled on Ceara's trading activity and determined the need for authorizations and the payment of a 0.5pc inspection fee on the trader's monthly income.
