Brazil advances gas pipeline category regulations

Brazil's oil and natural gas regulator ANP will draft regulations to determine the classification of distribution and transport infrastructure, which will have implications for the Subida da Serra pipeline project in Sao Paulo state.

These classifications are part of a broader process of regulating the 2021 natural gas law, which aims to increase competition in the natural gas market.

Classification of transport and distribution infrastructure is a particularly complex issue, because gas transport is regulated by the federal government, while distribution is under the jurisdiction of state governments.

ANP is working on a proposal to regulate the limits of state and federal oversight in the sector, with the goal of conducting public hearings in June. The regulator is working to establish rules to reconcile state and federal legislation.

While the 2021 gas law stipulates the diameter, pressure and length criteria for a pipeline to be classified as transport infrastructure, the agency also has the discretionary power to classify a specific pipeline as distribution infrastructure. This is as long as it does not interfere with long-term energy planning and if the pipeline's impact is limited to a specific region.

The outcome of the regulatory debate will directly affect the 31.5km (19.6-mile) Subida da Serra natural gas pipeline, which will deliver gas from the TRSP LNG terminal to consumers in the Sao Paulo metropolitan area. The state's regulatory agency Arsesp classified the project, which is being built by gas distributor Comgas, as distribution infrastructure in 2020, but ANP classified it as transport infrastructure in 2021.

Comgas will not be allowed to operate the pipeline when it is concluded later this year if it is classified as transport infrastructure.

Transportation should not be a bottleneck to increase gas sales and investments need to be made in line with demand, Brazil's gas distribution association (Abegas) director Marcelo Mendonca said at an ANP workshop last week.

The classifications for infrastructure need to be technical and any pipeline connected to a source of gas should be classified as transport infrastructure, according to gas transport association's (ATgas) regulatory manager Marina Cyrino.

For the director of the Brazilian petroleum institute (IBP) Sylvie d'Apote, ANP decisions should take precedence over those of state regulators.
