Calif governor orders recycling bill rewrite

California governor Gavin Newsom (D) has ordered a rewrite of California's producer responsibility program for plastic packaging, just as the regulations were set to be finalized.

The rewrite of some regulations is being carried out to minimize costs for small businesses and consumers, a governor's office spokesman said. The timeline for implementation of the bill (SB 54) will not change, the spokesman said. The law is set to take effect in 2027.

California's Department of Resources Recycling and Recovery (CalRecycle) had been set to finalize regulations for implementing SB 54 on March 8. The regulations were developed over two years, with initial draft regulations released in January 2024.

Environmental groups criticized the move, arguing that the rewrite was as a result of political pressure from industry groups.

"Industry lobbyists mounted an aggressive two-month campaign to press Newsom to shelve regulations that were developed with extensive public input over issues that are set in law," Monterey Bay Aquarium, Ocean Conservancy and Oceana said in a joint statement.

Prohibition of chemical recycling technologies and a $5bn plastic pollution mitigation fund under the law were particular targets of industry pressure, the groups argued.
