Brazil delays gas tariffs awaiting guidelines

Brazilian hydrocarbons regulator ANP's regulatory agenda for 2025-2026 suggests that the institution may be waiting for the state-run energy research firm EPE's guidelines before reviewing its transportation tariff calculations.

ANP published its regulatory agenda for the next two years, aiming at completing it by October, in time for EPE to make its regulatory proposal for the sector as planned.

EPE is preparing a 10-year plan to develop midstream infrastructure for natural gas and biomethane.

Because October is nearing and the transport tariffs review has been on the regulatory agenda since 2020, market participants expect ANP to comply with EPE's recommendations. But they are monitoring the move with caution and skepticism because this will be the first infrastructure plan for Brazil proposed by EPE and the regulation has been on the ANP's radar for five years.

ANP's agenda suggests that key decisions for the sector may have to wait until 2026 or beyond. Market participants said that the document points to an accumulation of tasks by the agency, which lacks personnel and has delayed most of its natural gas-related actions.

ANP's plan aiming to reduce market concentration is due in December 2026. The creation of the so-called gas release program was first recommended in 2023, but ANP delayed the project and took it off its agenda in 2024. The gas release program's return to ANP's agenda comes after Brazilian mines and energy minister Alexandre Silveira highlighted increasing competitiveness in the gas sector as one of the ministry's priorities.

A gas release program requires the company with dominant market position — that is, state-controlled Petrobras — to hold compulsory auctions to sell a share of its gas to other market participants.

Another theme under scrutiny is access to essential transport infrastructure, which has been postponed by ANP since 2022 and has now been left to be examined by May 2026.
