Corruption case could delay Petrobras refinery

The start-up of Brazilian state-controlled Petrobras' 165,000 b/d Comperj 1 oil refinery could be further delayed after executives with two of the project's main local contractors admitted to paying bribes.

Mendes Júnior vice president Sérgio Mendes and Galvão Engenharia director Erton Medeiros Fonseca yesterday admitted to federal police that they paid bribes to win contracts from Petrobras, the suspects´ respective lawyers said today.

On 14 November, federal police arrested 17 top executives from some of Brazil's biggest construction and engineering firms. The sweep is the latest phase of federal police investigations into a major kickback scheme that operated within Petrobras.

The confessions are the first time suspects have corroborated the claims of former Petrobras downstream director Paulo Roberto Costa and Alberto Yousseff, a currency broker alleged to be at the center of the kickback scheme.

A cartel comprised of the local firms allegedly agreed to inflated Petrobras contracts so part of the money could be diverted to the ruling Workers party (PT) and its coalition partners.

Considering rigid local content rules and a limited pool of domestic suppliers, the investigation has raised concerns over present and future contracts tied to Petrobras´ upstream and downstream projects. The company has said existing contracts will not be disrupted, but depending on the evidence contractors could be barred from participating in future contracts.

Petrobras says it is a "victim" of the alleged corruption and is investigating the matter.

The greenfield Comperj 1 refinery, now under construction in Rio de Janeiro state, was originally scheduled to come on stream in 2013, but is now tentatively scheduled to start operating in August 2016. The refinery was 66pc complete as of March, and was forecast to be 70pc complete this month. Petrobras was not available to confirm the current rate of progress.

The refinery will process 20˚API crude from the offshore Marlim field.

Mendes Júnior was contracted by Petrobras for part of the construction, electromechanical assembly and commissioning at Comperj, among other aspects of the project.

Credit rating agency Moody's yesterday downgraded Mendes Junior from B2 to B3 with a negative outlook. "Although investigations are still ongoing and no conclusions have been reached, we believe that these events could strain Mendes Junior's already tight liquidity and the execution of its short-term refinancing strategy," Moody's said.

Galvão Engenharia was contracted for the refinery´s distillate and kerosene hydrotreating units, sulfur recovery and storage units, and waste gas treatment at Comperj, among other parts of the project.

Comperj 1 is part of Petrobras´ plan to expand its existing 2mn b/d of refining capacity to keep pace with increasing products demand and trim costly imports. The company is currently starting up the first 115,000 b/d phase of its 230,000 b/d Abreu e Lima refinery in Pernambuco state. The $20bn Abreu e Lima project is the target of scrutiny over its ballooning costs.

Brazilian conglomerates Queiroz Galvão and Odebrecht also have existing contracts for construction and engineering services for Comperj. The offices of both firms were searched and documents seized during last week's sweep. Both companies deny any wrongdoing.

Foreign oil companies that have partnerships with Petrobras in high-profile sub-salt fields offshore have been circumspect so far. "We are observing developments, but this is a matter for Petrobras and we have no comment to make at this time," a BG spokesperson said today. BG has a broad presence in Brazil´s sub-salt play.

Last night, Brazilian federal judge Sérgio Moro extended the sentence of six suspects taken into custody last week, including top executives from construction firms Camargo Corrêa, OAS and UTC as well as Petrobras' former engineering and services director Renato Duque.
