AEP warns of not meeting emissions rules deadline

Colorado Springs, Colorado, 14 June (Argus) — The US's largest coal-fired power utility said today it cannot meet the deadline for compliance with new federal emissions rules.

American Electric Power (AEP) president Nick Atkins said the company cannot install the necessary technology to its coal-fired plants in time to comply with the Environmental Protection Agency's maximum achievable control technology rules by the 2014 compliance deadline.

“I can emphatically say it cannot get done,” Akins told delegates at the Edison Electric Institute's annual convention today.

The proposed rules require coal- and oil-fired power plants to install scrubbers and baghouses to reduce hazardous pollutants and particulate matter. The rules are scheduled to come into effect in 2014.

Atkins said the company agrees it needs to retire aging coal-fired power plants to transition toward cleaner generation. But he said AEP can achieve this by 2020, rather than by the agency's compliance date.

He said the agency's deadline will lead to premature retirements of coal plants that will cost jobs and harm the economy in those regions where the early retirements will take place.

AEP owns 25,000MW of coal-fired generation, the largest coal fleet in the US. Much of its fleet is nearing retirement age.

AEP last week said it would retire five plants and retrofit seven others to comply with the rules. The plan would retire 6,000MW of coal-fired capacity. The company had told investors on a 4 April conference call that it planned to retire 5,480MW of inefficient coal units.

Atkins urged the power industry to communicate with regional transmission organizations (RTOs) about the retirements that the agency's rules will bring about.

“RTOs need to step up and say exactly what needs to be done,” Atkins said.

Others were more optimistic about the compliance deadline. Exelon president Chris Crane said some of his company's fleet are close to compliance. Most of Exelon's generation is nuclear, which will be unaffected by the agency's emissions regulations.
