Industries subject to ETS exempt from French carbon tax

London, 23 September (Argus) — Industries that are included in the EU emissions trading scheme (ETS) will be exempt from the French carbon tax, according to prime minister Jean-Marc Ayrault.

Power generation and other sectors covered by the EU ETS, as well as the transport sector, would not be liable to pay the tax on fossil fuels, according to the government's draft budget law.

The draft law will be presented to the French cabinet on 25 September and, if adopted, the tax will come into force in 2014.

It had been unclear whether the measure would extend to the power generation sector and other industries covered by the EU ETS, after the previous government's attempt to introduce a carbon tax in 2010 was blocked by the constitutional court. The court judged that the tax created a disproportionate burden on industries not subject to the EU ETS because industries subject to the scheme were exempt from the tax, and at the time received free allowances.

The measure will be introduced progressively, with no impact on fuel bills in 2014, increasing to €2.5bn in revenue in 2015 and €4bn by 2016, according to the prime minister's estimates. Further details are expected in the draft law.

The carbon tax is intended to assist France in meeting its ambitious emissions and efficiency targets, including the reduction of total energy consumption by 50pc by 2050 and a 30pc cut in fossil fuel consumption by 2030.

French president Francois Hollande called for a European carbon tax to be introduced across the EU and for the restoration of the functioning of the EU ETS as a means of sending appropriate price signals for CO2 emissions.
