EPA plans audit of renewable fuel credit system

US environmental regulators are stepping up efforts to root out fraud in the trading of renewable fuel blending credits that some small refiners have called a drag on the industry.

The Office of Inspector General for the US Environmental Protection Agency (EPA) plans to audit trading of invalid Renewable Identification Numbers, a type of credit used to signify compliance with federal fuel blending standards, according to an EPA letter dated 17 September.

RIN credits, which are generated when renewable fuels are blended with traditional fuels for the US transportation supply, have been the subject of controversy since they were introduced as part of the Renewable Fuel Standard in the mid-2000's. Small independent refiners, which typically lack blending capabilities, have alleged the credits disproportionately affect them, while stakeholders on all sides of the issue have called for more transparency into RIN generation, trading and regulation.

In the audit, the EPA inspector will evaluate whether the agency's Moderated Transaction System used to verify RIN trades includes "controls to identify and reduce the generation and trading of invalid RINs."

The US over the past decade has successfully prosecuted a number of RIN fraud cases.

The EPA's latest probe into RIN trading was identified earlier this year as one measure the agency could use to ensure better data reliability as part of its fiscal year 2021 oversight plan. The inquiry comes at a time when rising prices for credits have prompted some obligated parties to step away from the market, while political calls for reformation of the credit system continue to increase.

Prices for RINs, as reflected by the Argus-assessed Renewable Volume Obligation (RVO) benchmark, reached all-time highs this summer, topping 20¢/USG, amid uncertainty about how the new administration of President Joe Biden planned to handle renewable fuel mandates after a raft of lawsuits from US refiners and biofuel interests. The RVO so far this month has averaged 16.08¢/USG, down from the recent record but still more than triple the price 16 months ago and more than five times the average price in 2019.

Several refiners, including Delek, have called RIN credits an "overhang on the industry." Delta Airlines, owner of the 185,000 b/d Trainer refinery outside Philadelphia, Pennsylvania, responded in July to a question about its RIN obligations by saying it was not planning to "spend good cash chasing a marketplace that isn't transparent."

The credit compliance system is also a hot-button political issue in states with strong refining and union interests, as well as those with the agricultural interests backing renewable fuels production. On 16 September, Pennsylvania lawmakers wrote a letter to President Biden claiming that the Trainer refinery's operators will be required this year to "spend twice as much to comply with the RFS program as it spent to purchase the entire company only ten years ago," in a plea to the White House to provide the EPA "with a stronger hand in stabilizing RINs pricing."

Conversely, biofuel lobby Growth Energy in a letter today asked the EPA to set "ambitious" biofuel blending targets when it updates RFS blending obligations later this year.

This is not the first time potential RIN fraud has come under the eye of US oversight bodies. In 2019, the US Government Accountability Office drew attention to "opportunities for fraud" in the trading of computerized RIN numbers, such as the double counting of RINs or generation of RINs for biofuels that do not exist.

Sao Paulo, 25 April (Argus) — A produtora de biocombustíveis Be8 buscará a Certificação Internacional em Sustentabilidade e Carbono (ISCC, na sigla em inglês) Corsia para comprovar que seu etanol à base de grãos está de acordo com as exigências internacionais para a produção de combustível de aviação sustentável (SAF, na sigla em inglês), contou hoje o CEO da empresa, Erasmo Carlos Battistella, à Argus . A companhia quer obter o certificado para sua nova e primeira planta de etanol, localizada em Passo Fundo, no Rio Grande do Sul. "Já estamos trabalhando nisso", disse Battistella. A usina terá capacidade de produzir 209.000 m³/ano do biocombustível e recebeu uma licença ambiental nesta semana. As operações devem começar em 2026. O ISCC é o principal sistema de certificação internacional para biomassa e bioenergia, com foco na sustentabilidade do uso da terra em conjunto com a rastreabilidade e a verificação dos gases de efeito estufa. Diversas empresas de etanol à base de cana-de-açúcar já receberam o certificado no Brasil – como Raízen, São Martinho, BP Bunge, Adecoagro, Copersucar e Zilor. A produtora de biocombustível de milho FS foi a primeira a conseguir o reconhecimento para o etanol de grãos. O Brasil, referência global em biocombustíveis como o etanol e o biodiesel, é considerado um grande player em potencial no SAF pela indústria de transporte aéreo e pelo Departamento de Energia dos EUA, devido à via de conversão pela tecnologia alcohol-to-jet (AtJ, na sigla em inglês). Etanol de milho deve compensar parte da queda da cana

Sao Paulo, 25 April (Argus) — A produção de etanol de milho compensará parcialmente uma queda no processamento do biocombustível à base de cana-de-açúcar na safra de 2024-25, de acordo com a Companhia Nacional de Abastecimento (Conab). A companhia espera que a produção total de etanol – de cana-de-açúcar e milho – para a temporada atual atinja 34,1 milhões de m³, baixa de 4pc em comparação ao ciclo recorde de 2023-24. O processamento total de anidro, usado como mistura para a gasolina, deve crescer 6,2pc, 892.500m³ a mais que na safra anterior, a 15,1 milhões de m³. Já o hidratado deve recuar 10pc, para 18,9 milhões de m³. Do total que será produzido no ano, a cana-de-açúcar deverá ser matéria-prima para 27,3 milhões de m³ deste volume, 8pc a menos do que na safra anterior, à medida que sua moagem deve diminuir 3,8pc, para 685,8 milhões de t. Isto se compara com 713,2 milhões de m³ em 2023-24, o maior valor já registrado no país. Condições climáticas adversas, como falta de chuvas e altas temperaturas no Centro-Sul, reduzirão a produtividade no período, reportou a Conab. Enquanto isso, a área de plantação de cana-de-açúcar subiu 4,1pc, para 8,6 milhões de hectares (ha), com mais áreas em expansão e renovação. As usinas também devem continuar favorecendo um mix mais açucareiro em detrimento do biocombustível. A organização espera que a produção de açúcar cresça 1,3pc, para 46,2 milhões de t. Os preços do açúcar estão mais atrativos no mercado internacional, com importantes exportadores como Índia e Tailândia diminuindo os embarques e abrindo espaço para a commodity brasileira. Nesse cenário, o processamento do etanol de milho deve compensar "parcialmente" o volume menor de biocombustível de cana, segundo a Conab. Serão produzidos 6,8 milhões de m³ do produto, alta de 16pc na base anual. O etanol de grãos está quebrando recordes a cada safra nos últimos anos, crescendo exponencialmente especialmente no Mato Grosso, Mato Grosso do Sul e Goiás. Indonesia's Pertamina to complete gasoline unit in Aug

Singapore, 25 April (Argus) — Indonesian state-controlled refiner Pertamina aims to finish building its new 90,000 b/d residual fluid catalytic cracker (RFCC) in the Balikpapan refinery in August, the firm said. The RFCC is a gasoline production unit, which typically uses residual fuel as a feedstock. The unit will be able to produce propylene, LPG and 92R gasoline that will meet the Euro V specifications, said Pertamina last week, without disclosing further details such as the start-up date. The newly built RFCC unit will be the largest in Indonesia, with the second-largest being the 83,000 b/d RFCC in Balongan and the third-largest the 54,000 b/d RFCC in Cilacap. The new RFCC will also help reduce Indonesia's reliance on gasoline imports. Indonesia currently imports around 9mn-11mn bl/month of gasoline, making it the largest gasoline buyer in the Asia-Pacific. The new RFCC will increase Pertamina's gasoline production by a conservative estimate of 45,000 b/d or 1.3mn bl, or around 10pc of Pertamina's current import demand, according to estimates from an oil analyst. The installation of the new RFCC is part of Pertamina's Refinery Development Master Plan (RDMP), which will take place in two phases. The first phase includes revamping existing units at the Balikpapan refinery, such as the crude distillation unit, vacuum distillation unit, and hydrocracking unit. It also involves building new units, such as the aforementioned RFCC, a gasoline hydrotreater, diesel hydrotreater, and naphtha hydrotreater. The second phase includes building a new residue desulphurisation unit. The RDMP also includes expanding the capacity of the Balikpapan refinery from 260,000 b/d to 350,000 b/d, said Pertamina's chief executive officer Nicke Widyawati. London, 24 April (Argus) — Spanish refiner and bunker fuel supplier Cepsa has recently delivered 150t of 100pc hydrotreated vegetable oil (HVO) by truck to the Ramform Hyperion at the port of Algeciras. The supply follows market participants reporting firmer buying interest for HVO as a marine fuel from ferry lines in the Mediterranean in recent sessions. The supplied HVO is said to be of class II, with used cooking oil (UCO) as the feedstock. Cepsa added that the supply was completed in cooperation with Bunker Holding subsidiary Glander International Bunkering, and could bring about a greenhouse gas (GHG) emissions reduction of up to 90pc compared with conventional fuel oil. Cepsa will also look to obtain capability to supply marine biodiesel blends exceeding 25pc biodiesel content by the end of the year, delegates heard at the International Bunker Conference (IBC) 2024 in Norway. This also follows plans by Cepsa to build a 500,000 t/yr HVO plant in Huelva , set to start production in the first half of 2026. New ISO 8217 eyes wider scope for alternative fuels

London, 24 April (Argus) — The 7th edition of ISO 8217, to be published in the second quarter of this year, will outline a broader integration of marine biodiesel blending, delegates heard at the International Bunker Conference (IBC) 2024 in Norway. Tim Wilson, principal specialist fuels of Lloyds Register's fuel oil bunkering analysis and advisory service (FOBAS), presented on the upcoming iteration of the ISO 8217 marine fuel specification standard, which will be released at IBC 2024. The new edition will incorporate specification standards for a wide range of fatty acid methyl ester (Fame)-based marine biodiesel blends up to B100, 100pc hydrotreated vegetable oil (HVO), as well as synthetic and renewable marine fuels. This will also include additional clauses to cover a wider scope, and briefly touch on biodiesel specifications that do not entirely align with road biodiesel EN-14214 specifications. This follows the emergence of widening price spreads for marine biodiesel blends because of specification differences and the lack of a marine-specific standard for the blends. The new edition of ISO 8217 is also expected to remove the limit of 7pc Fame when blended with distillate marine fuels such as marine gasoil (MGO) which was in place in the previous ISO 8217:2017. Other changes to distillate marine biodiesel blends include changes to the minimum Cetane Index, oxidation stability alignment to be connected to either ISO 15751 for blends comprising 2pc or more of Fame biodiesel and ISO 12205 for blends comprising a Fame component of under 2pc. Cold-filter plugging point (CFPP) properties will be determined by the vessel's fuel storage tanks' heating capabilities and requirements will be set in place to report the CFPP for distillate marine biodiesel grades, according to the new edition of the marine fuel specification standard. Wilson said that a minimum kinematic viscosity at 50°C will be in place for various forms of residual bunker fuel oil along with a viscosity control alerting suppliers to inform buyers of the exact viscosity in the supplied fuel. He said they have seen delivered fuel viscosity come in at much lower levels than ordered by the buyers, which was the reasoning behind the viscosity control monitoring requirement.
