Petrobras sale of LNG terminal under legal cloud

Brazilian federal prosecutors are advancing a legal case to remove all fuel storage and distribution operations from part of Pecem port, an industrial complex featuring an LNG terminal that state-controlled Petrobras is trying to sell.

Public prosecutor Ricardo Rocha told Argus that the fuel facilities in the Mucuripe terminal area of Pecem pose a risk to local residents.

The case, filed in May 2015 by independent Brazilian government prosecutors, is also demanding the removal of the 7mn m3/d LNG regasification terminal that is tethered offshore.

Prosecutors say fuel distribution companies, including Raizen Combustiveis and Petrobras unit BR Distribuidora, must remove their fuel storage facilities from the area, which the prosecutor classified as a densely populated urban area.

Rocha added that the population that lives in the vicinity of the fuel distribution facilities is at risk of an accident, such as the one the occurred in the Brazil's busiest port of Santos in April 2015.

The case could take until 2017 to resolve, in part because the Ceara state government needs to provide the prosecutors with additional information about the port complex, Rocha added.

In June, Petrobras formally announced that it would sell two of its three LNG regasification terminals, including Pecem, and their associated thermoelectric power plants. So far interest has been tepid, partly because of a mismatch between international LNG prices and long-term power supply agreements. The legal case at Pecem adds new uncertainty to the process.

Petrobras is also trying to sell a stake in BR Distribuidora. The sales are part of the company's ambitious privatization campaign.

In September, Ceara state signed a memorandum of understanding (MOU) with Korean state-controlled Kogas to build a $600mn onshore LNG terminal in the Pecem port complex.

The new terminal would have total capacity of 12mn m3/d, which could possibly be divided into two phases of 6mn m3/d each, a state official said.

The project is believed to have gained impetus from the legal case against the floating regasification unit.

In June, Petrobras transferred the 7mn m³/d Golar Spirit floating regasification and storage unit (FSRU) from Pecem to the Guanabara terminal outside Rio de Janeiro, and sent Excelerate Energy's 22.5mn m³/d Experience FSRU to Pecem, potentially increasing LNG imports to Pecem.

But deliveries remain sparse because of limited demand. During the first eight months of 2016, Brazil's LNG imports averaged a mere 4.99mn m3/d, compared to 18.15mn m3/d in the same period of 2015, according to the most recent monthly report issued by the Mines and Energy Ministry.

Brazil's LNG imports declined to 1.55mn m3/d in August, compared to 14.06mn m3/d in August 2015, reflecting a decline in thermoelectric power demand amid increased hydroelectric and wind generation.

The Pecem terminal received 800,000 m3/d in August, the largest share of LNG imports, followed by the Bahia terminal in Bahia state, which received 750,000 m3/d.

Norwegian firm Golar'sGolar Winteris scheduled to arrive at the port of Pecem on 15 November and Excelerate's Excelsior is scheduled to arrive on 21 November, according to local shipping agents.

Petrobras had not responded to requests for a comment on the case.
