Calif expands checks on renewable fuel projects

Northern California refiners converting traditional fuel processing units to make renewables will still need to follow the same rules as with older processes, as regulators take a closer look at lower-carbon fuel production.

The Bay Area Air Quality Management District (BAAQMD) plans to update its rules to make renewable fuel facilities subject to the same fees, emissions restrictions and performance standards currently applicable to petroleum refineries, it said in a request for comment published 21 September.

The changes come amid increasing attention to the environmental and community impacts associated with lower carbon fuel projects underway in the region. BAAQMD recently opened a probe into whether Phillips 66 violated permitting procedures involved in the ongoing conversion of its Rodeo facility in the120,000 b/d San Francisco refining complex. The regulator is performing inspections, information-gathering, and engineering reviews at the Rodeo site after environmental advocacy group the Natural Resources Defense Council (NRDC) asked it to look into whether Phillips 66 failed to apply for a permit for a hydrotreater conversion earlier this year.

Since Phillips 66 already has an active permitting process underway for a full conversion of the Rodeo facility expected in 2024, a potential breach of protocol of the kind alleged by NRDC would "transcend from odd to shocking," Ann Alexander, an attorney at the NRDC, told Argus.

The group already raised concerns in a letter sent to county regulator earlier this year about more than 11 potential consequences of the Rodeo conversion and expanded biofuel production, ranging from the deforestation impacts of farming for soybean feedstocks to emissions caused by the use of hydrogen units in renewable fuel refining.

Phillips 66 told Argus that it followed "all carefully reviewed applicable regulations and obtained all required approvals to produce renewable diesel from an existing hydrotreater unit as part of a standalone flexibility project." The company said that the Rodeo Renewed project does not require increased hydrogen generation, as the NRDC has suggested.

Tough market rules stay tough

But the regulatory probe and the forthcoming amendments to emissions standards may nonetheless speak to some of the challenges inherent in setting timelines for ambitious renewable fuel conversions in California.

Besides regional oversight enforced by groups like the BAAQMD, conversions are subject to additional permitting from programs overseen by the California Environmental Protection Agency, extensive environmental analyses, input solicitations from homes and businesses in fenceline communities, and review by the state's Division of Occupational Safety and Health, among other processes.

"Since this is new ground, it needs close scrutiny," Alexander said. "Hearing the proposed timelines coming from the oil companies on these projects, it's hard to see how they would work."

Further expansion of regulatory programs, as envisaged by BAAQMD, may give refiners cause for concern as they eye conversions intended to onramp them into burgeoning markets for renewable fuels and credits traded as part of California's Low Carbon Fuel Standard (LCFS) program. Alongside Phillips 66's effort at Rodeo, Marathon Petroleum is working to convert its 166,000 b/d Martinez refinery in the Bay area toward renewable diesel production. And more conversions figure to be forthcoming as demand for traditional fuels recedes in coming decades.

California-based Chevron, for example, which operates the 269,000 b/d El Segundo refinery near Los Angeles and the 250,000 b/d Richmond refinery in the Bay area, recently announced plans to spend $3bn on renewable diesel and sustainable aviation fuel production by 2028 as part of a $10bn energy transition spending program.

While the company has not announced conversion plans for its petroleum refineries in California, it has prioritized sustainable investments in its "home market," which couples close regulation with a lucrative carbon credit trading system. Chevron began processing of 2,000 b/d of renewable feedstocks for sustainable aviation fuel (SAF) production at El Segundo this month and has set a goal to convert a diesel hydrotreater at the facility for renewable diesel production by 2022.

BAAQMD has requested public comments on the draft amendments to be submitted by 11 October, ahead of a board of directors special meeting on 20 October.

London, 26 April (Argus) — Members of the European Parliament (MEPs) have adopted Net-Zero Industry Act, which plans to allocate funds towards the production of net-zero technologies. The act provides a pathway to scale up development and production of technologies that are critical towards meeting the EU's recommendation of net-zero greenhouse gas (GHG) emissions by 2050. This would include solar panels, electrolysers and fuel cells, batteries, heat pumps, onshore and offshore wind turbines, grid technologies, sustainable biomethane, as well as carbon capture and storage (CCS). The act is designed to help simplify the regulatory framework for the manufacture of these technologies in order to incentivise European production and supply. It also sets a target of 40pc production within the EU for its annual "deployment needs" of these technologies by 2030. Time limits will be instated on permit grants for manufacturing projects, at 12 months if the manufacturing capacity is under 1 GW/yr and 18 months for those above that. It will introduce time limits of nine months for "net-zero strategic projects" of less than 1 GW/yr and 12 months for those above. This is further complemented by the introduction of net-zero strategic projects for CO2 storage, to help support the development of CCS technology. The act was met with positive reactions from the European Community Shipowners' Association (ECSA), which said the bill will set the benchmark for member states to match 40pc of the deployment needs for clean fuels for shipping with production capacity. ECSA said the Net-Zero Industry Act will be instrumental in supporting the shipping industry to meet targets set under FuelEU Maritime regulations , which are set to come into effect next year. New technologies aim to boost SAF production

London, 26 April (Argus) — A likely rise in global demand for sustainable aviation fuel (SAF), underpinned by mandates for its use, is encouraging development of new production pathways. While hydrotreated esters and fatty acids synthesised paraffinic kerosine (HEFA-SPK) remains the most common type of SAF available today, much more production will be needed. The International Air Transport Association (Iata) estimated SAF output at around 500,000t in 2023, and expects this to rise to 1.5mn t this year, but that only meets around 0.5pc of global jet fuel demand. An EU-wide SAF mandate will come into effect in 2025 that will set a minimum target of 2pc, with a sub-target for synthetic SAF starting from 2030. This week the UK published its domestic SAF mandate , also targeting a 2pc SAF share in 2025 and introducing a power-to-liquid (PtL) obligation from 2028. New pathways involve different technology to unlock use of a wider feedstock base. US engineering company Honeywell said this week its hydrocracking technology, Fischer-Tropsch (FT) Unicracking, can be used to produce SAF from biomass such as crop residue or wood and food waste. Renewable fuels producer DG Fuels will use the technology for its SAF facility in Louisiana, US. The plant will be able to produce 13,000 b/d of SAF starting from 2028, Honeywell said. The company said its SAF technologies — which include ethanol-to-jet , which converts cellulosic ethanol into SAF — have been adopted at more than 50 sites worldwide including Brazil and China. Honeywell is part of the Google and Boeing-backed United Airlines Ventures Sustainable Flight Fund , which is aimed at scaling up SAF production. German alternative fuels company Ineratec said this week it will use South African integrated energy firm Sasol's FT catalysts for SAF production. The catalysts will be used in Ineratec's plants, including a PtL facility it is building in Frankfurt, Germany. The plant will be able to produce e-fuels from green hydrogen and CO2, with a capacity of 2,500 t/yr of e-fuels beginning in 2024. The e-fuels will then be processed into synthetic SAF. Earlier this month , ethanol-to-jet producer LanzaJet said it has received funding from technology giant Microsoft's Climate Innovation Fund, "to continue building its capability and capacity to deploy its sustainable fuels process technology globally". The producer recently signed a licence and engineering agreement with sustainable fuels company Jet Zero Australia to progress development of an SAF plant in north Queensland, Australia. The plant will have capacity of 102mn l/yr of SAF. Polish oil firm Orlen formed a partnership with Japanese electrical engineering company Yakogawa to develop SAF technology . They aim to develop a technological process to synthesise CO2 and hydrogen to form PtL SAF. The SAF will be produced from renewable hydrogen as defined by the recast EU Renewable Energy Directive (RED II) and bio-CO2 from biomass boilers, Orlen told Argus . Sao Paulo, 25 April (Argus) — A produtora de biocombustíveis Be8 buscará a Certificação Internacional em Sustentabilidade e Carbono (ISCC, na sigla em inglês) Corsia para comprovar que seu etanol à base de grãos está de acordo com as exigências internacionais para a produção de combustível de aviação sustentável (SAF, na sigla em inglês), contou hoje o CEO da empresa, Erasmo Carlos Battistella, à Argus . A companhia quer obter o certificado para sua nova e primeira planta de etanol, localizada em Passo Fundo, no Rio Grande do Sul. "Já estamos trabalhando nisso", disse Battistella. A usina terá capacidade de produzir 209.000 m³/ano do biocombustível e recebeu uma licença ambiental nesta semana. As operações devem começar em 2026. O ISCC é o principal sistema de certificação internacional para biomassa e bioenergia, com foco na sustentabilidade do uso da terra em conjunto com a rastreabilidade e a verificação dos gases de efeito estufa. Diversas empresas de etanol à base de cana-de-açúcar já receberam o certificado no Brasil – como Raízen, São Martinho, BP Bunge, Adecoagro, Copersucar e Zilor. A produtora de biocombustível de milho FS foi a primeira a conseguir o reconhecimento para o etanol de grãos. O Brasil, referência global em biocombustíveis como o etanol e o biodiesel, é considerado um grande player em potencial no SAF pela indústria de transporte aéreo e pelo Departamento de Energia dos EUA, devido à via de conversão pela tecnologia alcohol-to-jet (AtJ, na sigla em inglês). Etanol de milho deve compensar parte da queda da cana

Sao Paulo, 25 April (Argus) — A produção de etanol de milho compensará parcialmente uma queda no processamento do biocombustível à base de cana-de-açúcar na safra de 2024-25, de acordo com a Companhia Nacional de Abastecimento (Conab). A companhia espera que a produção total de etanol – de cana-de-açúcar e milho – para a temporada atual atinja 34,1 milhões de m³, baixa de 4pc em comparação ao ciclo recorde de 2023-24. O processamento total de anidro, usado como mistura para a gasolina, deve crescer 6,2pc, 892.500m³ a mais que na safra anterior, a 15,1 milhões de m³. Já o hidratado deve recuar 10pc, para 18,9 milhões de m³. Do total que será produzido no ano, a cana-de-açúcar deverá ser matéria-prima para 27,3 milhões de m³ deste volume, 8pc a menos do que na safra anterior, à medida que sua moagem deve diminuir 3,8pc, para 685,8 milhões de t. Isto se compara com 713,2 milhões de m³ em 2023-24, o maior valor já registrado no país. Condições climáticas adversas, como falta de chuvas e altas temperaturas no Centro-Sul, reduzirão a produtividade no período, reportou a Conab. Enquanto isso, a área de plantação de cana-de-açúcar subiu 4,1pc, para 8,6 milhões de hectares (ha), com mais áreas em expansão e renovação. As usinas também devem continuar favorecendo um mix mais açucareiro em detrimento do biocombustível. A organização espera que a produção de açúcar cresça 1,3pc, para 46,2 milhões de t. Os preços do açúcar estão mais atrativos no mercado internacional, com importantes exportadores como Índia e Tailândia diminuindo os embarques e abrindo espaço para a commodity brasileira. Nesse cenário, o processamento do etanol de milho deve compensar "parcialmente" o volume menor de biocombustível de cana, segundo a Conab. Serão produzidos 6,8 milhões de m³ do produto, alta de 16pc na base anual. O etanol de grãos está quebrando recordes a cada safra nos últimos anos, crescendo exponencialmente especialmente no Mato Grosso, Mato Grosso do Sul e Goiás. MDBs, parties must deliver on finance: Cop 29 president

Edinburgh, 25 April (Argus) — Cop 29 president-designate Mukhtar Babayev pointed to insufficient action from multilateral development banks (MDBs) despite encouraging discussions, and urged all countries to play their part to deliver on climate finance negotiations this year. Climate finance discussions will be an important part of climate negotiations this year, having been "one of the most challenging climate diplomacy topics over the years", Babayev said today at the 15th Petersberg climate dialogue in Berlin — a forum for multilateral discussions. The meeting is a key milestone in climate discussions, paving the way for Cop 29 negotiations. The topic will be key as countries must decide on a new global finance goal to replace the $100bn/yr by 2020 pledge to developing countries made in 2009 and missed by developed countries. Babayev said he was working with a range of actors including MDBs, which have a "special role" as "multilateral public finance contributed the single largest part of the [$100bn/yr] target". Babayev said progress from the MDBs was essential, but while he "had many encouraging engagements during the World Bank and IMF spring meetings in Washington last week , we heard a great deal of concern and worry that we did not yet see adequate and sufficient action". "That must change," he said. He also warned that there is no single initiative able to unlock and increase climate finance flows to trillions of dollars, and instead pointed to "many interconnected elements" that countries will need to consider to set this new finance goal — the so-called NCQG. He added that the NCQG working group has already identified many options. "We know that [there are] strong and well-founded views on all sides," he said. "We are listening to all parties to understand their concerns and help them refine official landing zones based on a shared vision of success so we can deliver a fair and ambitious new goal," he added. "We need everyone to play their part so that we can build up unstoppable momentum where everyone is confident that their contribution is fairly matched by the contributions of others". Germany's foreign minister Annalena Baerbock said industrialised countries need to live up to their responsibilities. "Financial contributions from developed countries and multinational development banks will remain the basis of our efforts," she said, confirming that Germany has a €6bn climate goal for 2025. But she also said that "the world has changed" since the UN climate body the UNFCCC established a list of climate finance donors in 1992. The list has just 24 countries, plus the EU, as contributors. "In 1992, the two dozen countries that provided international climate finance made up 80pc of the world's economy. Now, that share is down to 50pc, and the share of all other countries has more than doubled," she said. She urged other countries in the G20, including China, "to join our effort". She pointed out that the donor base was broader for the loss and damage fund — to tackle the unavoidable and irreversible effects of climate change. Cop 28 host the UAE, which is not part of the 1992 list of donors, was the first contributor of the new fund created in Dubai last year. Babayev said that finance will not be the only important topic discussed at Cop 29 and that work must be done to get "the loss and damage fund up and running". Finalising the Article 6 negotiations will also be a key issue. "We cannot leave everything to market mechanisms," he said.
