Liberty Steel Ostrava's sole power supplier to close

Tameh Czech, Liberty Ostrava's sole power supplier, is shutting down as it has no money to buy coal because of non-payment by Liberty, according to a letter seen by Argus.

Tameh states that it is owed 2bn koruna (€81.8mn) by Liberty, and that it also has outstanding invoices totalling more than Kc1.2bn. Liberty Ostrava is the plant's only customer and its "non-payment has caused a catastrophic financial situation for Tameh, depleted all potential reserves and resulted in Tameh not being able to purchase any more coal", the letter states. Liberty has not paid Tameh since June, a spokesperson told Argus.

"Tameh has no other option than to shut down its plant this week and use all available legal steps to keep Liberty solely liable for its reckless behaviour," he added.

A Liberty Ostrava spokesperson said the company was "disappointed by this unilateral threat" and that Liberty had offered to provide Tameh with coal while "negotiations" continue.

When Liberty agreed to buy Ostrava from ArcelorMittal, alongside a number of other assets, it was also poised to acquire Tameh, but that deal did not complete. Tameh is 50pc owned by ArcelorMittal, which has been pursuing Liberty for payment of €140mn in relation to that wider acquisition.

There was a flat fee for energy supply under the Tameh-Ostrava contract, Argus understands. Liberty has complained about the high prices it pays Tameh under that contract — Liberty received Ck661.77mn in government support to "reduce these prices", Tameh states in its letter.

Liberty secured a 30-day moratorium against Tameh at the end of last month. As part of the protection, it must submit a restructuring plan to the court, although industry sources expect it to ask for an extension.

The plan involves "temporarily" stopping production where demand is low, such as for wire rod, and also involves a review of coke operations, as the price of merchant coke is almost at parity with that of coking coal.

Tameh supplies all Ostrava's heat and power, so its stoppage means Liberty will not be able to restart blast furnaces or operate coke ovens. Ostrava can produce 3.6mn t/yr, and said yesterday that it will restart its blast furnace in January.

Liberty said it will use the "opportunistic acquisition of low-cost" semi-finished imports to feed its rolling lines as part of a restructuring plan. It has already been importing Russian semi-finished steel financed by traders for rolling at EU assets.
