Brazilian gas distribution profits become flashpoint

Market participants want to review the percentage of profit margins for state natural gas pipeline distribution companies, which represents an average of 17pc of final tariff values, according to official energy research firm EPE.

In Brazil, the average profit margin on tariffs charged by state piped natural gas distributors increased by 37pc on top of the 33pc IPCA inflation rate from 2019-2023, according to a survey by large energy consumers association Abrace. The study used data from 13 distribution companies.

Distribution concession contracts and regulation should aim to lower costs to increase demand, displacing other energy sources and fostering economic activity, especially for industrial customers, the main consumer of natural gas, Abrace's gas director Adrianno Lorenzon said.

The debate gained traction last month in Sergipe state as its regulatory agency, Agrese, organized a public hearing to discuss a 20pc investment remuneration rate in the 50-year concession contract with state distribution company Sergas, signed in 1994.

Besides Sergipe, the northeastern states of Alagoas, Bahia, Ceara, Pernambuco and Paraiba, central-western Mato Grosso do Sul state and southern Rio Grande do Sul and Santa Catarina states also have a 20pc profit margin by contract. The tariff review processes occur annually in these states.

Santa Catarina's government is also holding discussions with industry federation Fiesc and its state regulatory agency and distribution gas company to review conditions to lower tariffs.

The tariff review occurs every five years in Rio de Janeiro, Sao Paulo, Minas Gerais, Espirito Santo and Parana states, and the contracts range from 30-50 years. The tariff of gas distributor Necta — from Sao Paulo — is set to be reviewed in the next couple of months. The last review of Sao Paulo-based Comgas — which serves 25pc of Brazilian market — took place in December 2022.

The distribution margin of natural gas distribution companies aims to cover both distribution and sales services, as well as investments to expand the gas pipeline network.

During the Sergipe public hearing in July, the Brazilian center for regulation and infrastructure's director Joisa Dutra said that contracts can be revisited without infringing regulations as long as there is an agreement between the parties.
