Australian activists challenge Ulan coal mine extension

Australian environmental activist group the Mudgee District Environmental Group (MDEG) is challenging the New South Wales government's approval of a two-year extension of the Ulan underground mine, which is owned by Swiss mining company Glencore.

MDEG believes that NSW's Independent Planning Commission made several procedural errors, including failing to consider the local impact of climate change, when it approved Glencore's application, a spokesperson from the activist group told Argus on 3 September.

NSW state regulators on 22 May approved a two-year extension for Glencore's 20mn t/yr Ulan thermal coal mine, extending the mine's operations to 2035 from 2033.

The case is aimed at using a legal loophole from a recent court decision to delay or stop the project, Glencore told Argus.

NSW's Court of Appeal blocked Australian producer MACH Energy's plan to extend the life of its Mount Pleasant mine by 22 years, in July, over local climate effects. The court's ruling indicated that regulators need to consider the local impact of climate change when assessing projects with high scope 3 emissions.

Glencore's Ulan expansion, which will allow the company to produce an additional 18.8mn t of run-of-mine (ROM) thermal coal, will increase the company's scope 3 emissions by 41.7mn t of CO2 equivalent (CO2e), as well as its scope 1 and 2 emissions — mostly from waste gas and electricity use — by 134,938t of CO2e, over the next decade.

Australia's Safeguard Mechanism, a scheme under which emitters pay for excess carbon emissions, does not apply to the Ulan mine because it generates less than 100,000 t/yr of CO2e scope 1 emissions — the scheme's emissions threshold.

Glencore has faced recent operational challenges at Ulan. Underground workers launched a series of work stoppages at the mine in July, halting production over a pay dispute.
