EPA proposes record US biofuel mandates, foreign limits

President Donald Trump's administration today proposed requiring record biofuel blending into the US fuel supply over the next two years, including unexpectedly strong quotas for biomass-based diesel.

The US Environmental Protection Agency (EPA) proposal, which still must be finalized, projects that oil refiners will need to blend 5.61bn USG of biomass-based diesel to comply with requirements in 2026 and 5.86bn USG in 2027. That's a 67pc increase in 2026 and a 75pc increase in 2027 from this year's 3.35bn USG requirement, above what most industry groups had sought.

The proposal alone is likely to boost biofuel production, which has been down to start the year as biorefineries have struggled to grapple with uncertainty about future blend mandates, the halting rollout of a new clean fuel tax credit, and higher import tariffs.

The EPA proposal also would halve Renewable Identification Number (RIN) credits generated for foreign biofuels and biofuels produced from foreign feedstocks, a major change that could increase US crop demand and hurt renewable diesel plants that source many of their inputs from abroad. US farm groups have lamented refiners' rising use of Chinese used cooking oil and Brazilian tallow to make renewable diesel, and EPA's proposal if finalized would sharply reduce the incentive to do so.

The Renewable Fuel Standard program requires US oil refiners and importers to blend biofuels into the conventional fuel supply or buy credits from those who do. One USG of corn ethanol generates one RIN, but more energy-dense fuels like renewable diesel can earn more.

In total, the rule would require 24.02bn RINs to be retired next year and 24.46bn RINs in 2027. That includes a specific 7.12bn RIN mandate for biomass-based diesel in 2026 and 7.5bn in 2027, and an implied mandate for corn ethanol of 15bn RINs, similar to prior years. EPA currently sets biomass-based diesel mandates in physical gallons but is proposing a change to align with how targets for other program categories work.

US soybean oil futures surged following the release of the EPA proposal, and RIN credits rallied similarly. Current year D6 credits, typically generated from conventional ethanol production, traded at 92¢/RIN near the opening of the session before peaking at 110¢/RIN and then retreating slightly. Current year biomass-based diesel D4 RINs followed a similar trajectory, trading up to 116¢/RIN and widening the gap with conventional D6 RINs.

Proposed targets are less aspirational for the cellulosic biofuel category, where biogas generates most credits. EPA proposes lowering the 2025 mandate to 1.19bn RINs, down from from 1.38bn RINs previously required, with 2026 and 2027 targets proposed at 1.30bn RINs and 1.36bn RINs, respectively. In a separate final rule today, EPA cut the 2024 cellulosic mandate to 1.01bn RINs from 1.09bn previously required, a smaller cut than initially proposed, and made available special "waiver" credits refiners can purchase at a fixed price to comply.

Small refinery exemptions

The proposal includes little clarity on EPA's future policy around program exemptions, which small refiners can request if they claim blend mandates will cause them disproportionate economic hardship. EPA predicted Friday that exemptions for the 2026 and 2027 compliance years could total anywhere from zero to 18bn USG of gasoline and diesel.

EPA plans to continue a policy from past administrations of estimating future exempted volumes when calculating the percentage of biofuels individual refiners must blend, effectively requiring those with obligations to shoulder more of the burden to meet high-level volume targets. EPA in the proposal said it plans to "communicate our policy regarding [exemption] petitions going forward before finalization of this rule".

Industry groups expect the agency will try to conclude the rule-making before November.

Notably though, the proposal says little about how EPA is weighing a backlog of more than a hundred requests for exemptions stretching back to 2016. Many of these refiners had already submitted RINs to comply and could push for some type of compensation if granted retroactive waivers, making this part of the program especially hard to implement. An industry official briefed on Thursday ahead of the rule's release said Trump administration officials were "coy" about their plans for the backlog.

The proposed mandates for 2026-2027 will have to go through the typical public comment process and could be changed as regulators weigh new data on biofuel production and food and fuel prices. Once the program updates are finalized, lawsuits are inevitable. A federal court is still weighing the legality of past mandates, and the Supreme Court is set to rule this month on the proper court venue for litigating small refinery exemption disputes.

Sao Paulo, 15 July (Argus) — Brazil is focused on reversing the tariff hike imposed by US president Donald Trump and will only ask for a postponement if necessary, Brazilian vice-president Geraldo Alckmin said on Tuesday after meeting with agribusiness representatives. Trump last week threatened to impose a 50pc tariff on imports from Brazil as of 1 August , citing a criminal trial against former president Jair Bolsonaro for attempting to overthrow the country's 2022 election results. At a press conference after the meeting today representatives from different agribusiness sectors were in agreement that the dialogue with the US government needs to continue. Agriculture ministry Carlos Favaro said that "dialogue [between the two countries] is open on the Brazilian side, but with respect for sovereignty and with great pride". Beef, orange juice and coffee are among agricultural products Brazil exports the most to the US, according to Brazil's ministry of development, industry, commerce and services. Brazil's meatpacking plants are stopping production because of the likely effects that the 50pc tariffs could have on the market, according to the president of Brazil's association of meat exporting industries Abiec, Roberto Perosa . The US is the second largest importer of Brazil's beef, only behind China. The US already imposes tariffs of around 36pc on Brazil's beef sector, according to Perosa, and an additional 50pc tariff "would practically make exports to the US unfeasible." Citrus juice exporters are also concerned about the possible new tariffs, especially considering that the 2025-26 orange season started in June and goes through December-January. Brazil accounts for 70pc of the orange juice the US imports, according to Brazil's national association of citrus juice exporters CitrusBR. The group's president, Ibiapaba Netto, said that "there is still time for negotiation" until 1 August and that "it is necessary to maintain pragmatism". Brazil published today a decree regulating the economic reciprocity law, which establishes criteria for suspending trade concessions, investments and obligations related to intellectual property rights in response to unilateral measures adopted by countries or economic blocs that may negatively impact Brazil's international competitiveness. US claims energy-focused Indonesia trade deal

Washington, 15 July (Argus) — President Donald Trump said today he has secured a trade deal with Indonesia that would involve additional sales of US energy and agricultural commodities and Boeing aircraft. The deal, which Jakarta has yet to confirm, would commit Indonesia to buying $15bn worth of US energy commodities, $4.5bn of agricultural products and 50 Boeing aircraft, Trump said via his social media platform. Speaking to reporters earlier on Tuesday, Trump said the US, under the deal, would impose a 19pc tariff on all imports from Indonesia while that country would impose no tariffs on US products. Trump said he finalized the trade deal after speaking with Indonesia's "Highly Respected President" Prabowo Subianto Tuesday morning. Prabowo has just concluded a trade deal with the EU, which would result in mutual lowering of tariffs on trade. No other details on the US-Indonesia deal were immediately available from the White House and US trade agencies. Trump last week threatened to impose a 32pc tariff on all imports from Indonesia, beginning on 1 August. Indonesia's government has already directed state-owned Pertamina to assess the potential for importing refined products from the US. That directive coincided with a parallel push by Pertamina to shift away from importing oil products from Singapore and import more fuel from the Middle East and the US. The Trump administration since 5 April has been charging a 10pc extra "Liberation Day" tariff on most imports — energy commodities and critical minerals are exceptions — from Indonesia and nearly every foreign trade partner. Trump last week publicized letters sent to leaders of 24 countries, including Indonesia, dictating new, higher tariff rates he said would apply beginning on 1 August. The Trump White House said in April it expected to sign "90 deals in 90 days" following his "Liberation Day" tariffs. The US has clinched only one limited trade deal, which keeps in place a 10pc tariff on US imports from the UK while granting a lower-tariff import quota for UK-made cars. Trump has announced a deal with Vietnam, setting tariffs at 20pc, but other terms remain unknown. A preliminary trade deal with China, agreed in early May, established a separate 10 August deadline for reaching an agreement on tariffs. The US administration is engaged in talks with the EU, Canada and Mexico despite Trump's threats to raise tariffs on imports from those destinations to 30-35pc. Brazil, on the other hand, said it would reciprocate with higher tariffs on US products after Trump threatened to impose a 50pc tariff on imports from Brazil. Trump has justified imposing his "Liberation Day" tariffs by citing an economic emergency caused by allegedly unfair trade practices in foreign countries. His emergency-based tariff authority is facing challenges in US courts, with two lower-level courts ruling already in May that the White House could not impose such tariffs. The US Court of Appeals for the Federal Circuit will hold a hearing on 31 July in a case pitting the administration against a group of plaintiffs, including many US states. The US Court of International Trade, in an initial ruling on 28 May, found that Trump's emergency tariffs were unlawful and ordered the administration to rescind the import taxes and to refund already collected duties. Brazil attorney general asks court to convict Bolsonaro

Sao Paulo, 15 July (Argus) — Brazilian prosecutors said the country's supreme court (STF) should find former president Jair Bolsonaro and seven other defendants guilty of an attempted coup. In a 517-page briefing that is part of attorney general Paulo Gonet's closing arguments at trial, prosecutors argue that Bolsonaro and the other defendants should be convicted of the crimes of armed criminal organization, attempted violent abolition of the democratic rule of law, coup d'état, damage qualified by violence and serious threat, and damage to government assets. Bolsonaro was the "main orchestrator and biggest beneficiary" of a plot to make sure that he stayed in power despite losing the election to President Luiz Inacio Lula da Silva, Gonet said during the trial. The plot included the 8 January 2023 storming of government buildings in the capital Brasilia and plans to kill his political opponents . Also as part of the plot, Bolsonaro used the power of the state and operated in a "persistent scheme" to attack public institutions and the succession process after the presidential election results, Gonet said. The seven other defendants include Bolsonaro's running mate Walter Braga Netto; former minister Augusto Heleno, who is also an army general; Bolsonaro's former justice minister Anderson Torres; former defense minister Paulo Sergio Nogueira; and Bolsonaro's top aide Mauro Cid. If convicted, Cid is expected to have his sentence suspended due to a plea bargain agreement signed with the federal police during investigations. Cid will now have 15 days to present his final defense. The other defendants will then have an additional 15 days to do the same. A date for the justices to begin deliberations will be set after STF receives all statements. That is expected for September this year, according to the government. If convicted, the defendants, including Bolsonaro, can face up to 43 years in prison. Bolsonaro, Trump push back Bolsonaro — who is barred from running for any public office until 2030 — used social media to call the trial a "shameful farce". Bolsonaro's trial gained a new spotlight after US president Donald Trump threatened to impose a 50pc tariff on imports from Brazil from 1 August, citing an alleged "witch hunt" against Bolsonaro. Lula said Brazil will reciprocate the US tariffs. "Any unilateral tariff increases will be addressed in accordance with Brazil's economic reciprocity law," he said on social media last week. He also added that the country "will not accept any form of tutelage." Lula signed the reciprocity law on Monday, according to the government. It authorizes Brazil to suspend trade, investment and obligation concessions to countries that impose unilateral barriers to Brazilian products in the global market. It also creates a committee — which will be comprised of the ministers of trade, finance, foreign relations and the chief of staff — that will be in charge of deciding trade responses to other countries' unilateral measures. Sydney, 15 July (Argus) — New Zealand's centre-right coalition government has released a draft plan to make its fuel supply chains resilient and invited feedback from the local stakeholders and industry on the proposals. New Zealand wants to guard against supply disruptions, improve domestic infrastructure, develop low-carbon fuel alternatives locally and transition to new energy technologies in the next decade. Public submissions on the plan open 15 July and run until 25 August. Special economic zones have been mooted to provide tailored regulatory areas for developers of biofuels and other alternatives such as hydrogen to ease investment hurdles. The draft comes after New Zealand pledged to increase legally required fuel reserves and mandate that more jet fuel is kept at Auckland airport — the nation's busiest. Earlier this year, a government study found that reopening the shuttered 135,000 b/d Marsden Point refinery to ensure fuel supply could cost the country billions of dollars and take years to complete. Instead, it was recommended that the government find alternative solutions to securing supply like increasing in-country reserves and developing biofuels. The Marsden Point refinery supplied about 70pc of New Zealand's fuel requirements before it was transformed into an oil products import terminal in 2022. As New Zealand's transport sector starts adopting electric vehicles, gasoline consumption will diminish. Diesel demand will taper off by 2035 while the jet fuel market is expected to grow for the foreseeable future due to a lack of alternatives currently, the draft said. Sustainable aviation fuel (SAF) could eventually form part of New Zealand's energy mix. New Zealand's gasoline imports totalled 53,000 b/d in January-March , diesel imports were 71,000 b/d and jet fuel 33,000 b/d, according to the country's business, innovation and employment ministry. Mexico to negotiate Trump’s tariffs: Sheinbaum

Mexico City, 14 July (Argus) — Mexico believes it can reach a deal with US president Donald Trump after he said he would impose 30pc tariffs on goods imported from Mexico beginning on 1 August. Over the weekend Trump made public on his social media platform a letter sent to Mexican president Claudia Sheinbaum on Friday, threatening the new tariffs. The move could significantly disrupt crude flows from Mexico to the US, and refined product flows from the US to Mexico. Mexico's ministries of the economy, foreign affairs, finance, security and energy said in a statement Saturday that they met with their US counterparts on Friday to begin negotiations to head off the new tariffs before 1 August. The Mexican ministries called the new tariff plan "unfair treatment." With the working group— created by the US State Department — leading the talks, Sheinbaum said today she trusts a deal can be made before 1 August. It is not clear if the 30pc tariff threat applies to trade currently covered by the US-Mexico-Canada trade agreement (USMCA). A White House official said previously that a 35pc tariff against Canada would not include USMCA-covered trade, but that those terms could change. Mexico also has a plan should no deal be reached, Sheinbaum said, without specifying details. When previously threatened with tariffs, Sheinbaum discussed plans to bolster Mexico's economy to become more resilient in the face of disrupted trade with its top trade partner, as well as unspecified retaliatory tariffs. But Trump vowed to raise the tariffs even higher if Mexico was to retaliate with its own measures. In his initial letter to Sheinbaum, Trump repeated previous justifications for higher tariffs by pointing to Mexico's "failure" to stop criminal groups from smuggling fentanyl into the US. Trump recognized that Mexico is working on the issue but does not consider these efforts fruitful: "Mexico has been helping me secure the border, BUT, what Mexico has done is not enough," Trump wrote. Trump sent a similar letter threatening tariffs on Friday to European Commission president Ursula von der Leyen. The US has clinched only one limited trade deal, which keeps in place a 10pc tariff on US imports from the UK while granting a lower-tariff import quota for UK-made cars.
